LEGACY PROJECT CONTRIBUTOR TERMS AND CONDITIONS

A. ACCEPTANCE OF TERMS AND CONDITIONS

The Yale-NUS College Legacy Project (“Legacy Project”) consists of physical exhibitions, activities, commemorative publications, materials and memorabilia organised and archived to commemorate the history of Yale-NUS College. It includes physical and digital heritage materials and memorabilia curated and archived in the Yale-NUS College Legacy website (“Legacy Website”) and the Yale-NUS College Digital Archives (“College Digital Archives”).

The Legacy Project, Legacy Website and College Digital Archives are created, organised, owned and maintained by Yale-NUS College (“College”), an autonomous college established within the National University of Singapore (“NUS”).

All title and rights to the Legacy Project, Legacy Website and College Digital Archives are reserved to NUS.

“Contribution” in these Terms and Conditions shall mean all media or material in any form (including but not limited to documents, publications, illustrations, photographs, videos, audio files, and other materials or ephemera, whether in audio, visual, physical or digital format) submitted by you to the College.

In consideration of the possible use or inclusion of the Contribution in the Legacy Project and/or Legacy Website and/or College Digital Archives, you (“Contributor”) confirm that you accept these Terms and Conditions in full.

B. TERMS AND CONDITIONS

  1. Contributor grants to the College and NUS a royalty-free, irrevocable, perpetual and non-exclusive licence to use, share, reproduce and/or preserve the Contribution in or in relation to the Legacy Project, Legacy Website and/or College Digital Archives. Contributor confirms and warrants it holds the necessary title, rights or permissions in relation to the Contribution to grant the aforesaid licence. The College and NUS may transfer or assign the licence in any way they deem fit, including but not limited as part of the transfer of the Legacy Project, Legacy Website and/or the College Digital Archives to Yale University or other third parties for archival or historical purposes. Save for the licence, all title and rights over the Contribution is retained by the holder(s) of such title or rights.
  2. Contributor shall ensure that the Contribution does not breach any applicable laws, or (if the Contributor is a College or NUS staff/student) the College’s and NUS’ rules and regulations.
  3. Contributor is responsible for the quality, validity and authenticity of the content of the Contribution, including but not limited to text, images, graphics, audio and video files, website links, computer programmes or other content.
  4. Contributor must obtain any consent from individuals revealed or involved in the Contribution, necessary for the Contribution to be made available to the public through the Legacy Project, Legacy Website or College Digital Archives.
  5. The Contributor represents and warrants that:

    1. the Contribution, and its use in or in relation to the Legacy Project, Legacy Website or College Digital Archives, do not and/or will not conflict with any agreements related to the Contribution (including but not limited to publisher agreements);
    2. the Contribution does not contain and/or will not install any viruses, worms, malware, Trojan horses or other harmful or destructive content;
    3. the Contribution is not spam, and is not content designed to further unlawful or misleading acts such as phishing or spoofing;
    4. the Contribution is not pornographic, defamatory, discriminatory, incendiary, threatening, abusive, vulgar, obscene, profane, plagiaristic and does not contain threats or material that might incite violence or animosity towards individuals or entities;
    5. the Contribution is not confidential information and, when used in or in relation to the Legacy Project, Legacy Website or College Digital Archives, will not constitute a breach of any confidentiality undertaking or otherwise violate the privacy or other rights of any third party; and
    6. the Contribution does not contain material that may damage the reputation or goodwill of the College and/or NUS.
  6. Withdrawals and Corrections:

    1. Any Contribution to the Legacy Project, Legacy Website and/or College Digital Archives is permanent and irrevocable. Contribution may only be withdrawn by the College, NUS or the Contributor under exceptional circumstances, including license agreement violations, legal requirements violations, ethical violations or falsified research, proven copyright infringement or plagiarism or content contains defamatory statements. Contributors wishing to seek withdrawal of its Contribution may email the administrators of the Legacy Project at legacy@yale-nus.edu.sg.
    2. The College and/or NUS may restrict access to, omit or delete any Contribution from the Legacy Project, Legacy Website or College Digital Archives if it deems in its sole judgment to have violated the Terms and Conditions at any time, without notice or reason given and without liability.
  7. These Terms and Conditions shall be governed by and construed in accordance with the laws of Singapore, and any dispute shall be subject to the jurisdiction of the Singapore courts.

C. DISCLAIMER

THE CONTRIBUTOR ACKNOWLEDGES AND AGREES THAT ALL INFORMATION ON THE LEGACY PROJECT, LEGACY WEBSITE AND COLLEGE DIGITAL ARCHIVES IS PROVIDED "AS IS".

The Legacy Project, Legacy Website and College Digital Archives are created, organised, owned and maintained by Yale-The College and/or NUS give no warranty and accept no responsibility or liability for the accuracy or the completeness of the information and materials provided for any purpose whatsoever, and no reliance should be made by the Contributor on the said information or material.NUS College (“College”), an autonomous college established within the National University of Singapore (“NUS”).

The College and NUS reserve the right at any time, from time to time, to make changes to the whole or any part of these Terms and Conditions and/or the Legacy Project, Legacy Website or College Digital Archives as deemed appropriate.

The Legacy Project, Legacy Website or College Digital Archives may contain links to other websites or involve resources or services operated by parties other than the College or NUS. As the College and NUS have no control over such sites, resources or services, the Contributor agrees that the College and NUS are not responsible nor liable, whether directly or indirectly, for any damage or loss caused or sustained by the Contributor, in connection with or arising from the use or reliance on such linked sites, resources or services.

The Contributor agrees to indemnify the College and/or NUS against any claims made against the College and/or NUS by any third party due to or arising out of the use of the Contribution. The Contributor further agrees that the College and NUS shall not be held responsible or be liable in any way for any consequences, damages or loss that may be incurred by the Contributor as a direct or indirect result of the use of (or the inability to use) the Contribution, even if the College or NUS has been advised of the possibility of such damages.

D. NUS/COLLEGE POLICIES

These Terms and Conditions shall be read in conjunction with, and are subject to, the following College or NUS policies  if the Contribution includes any research, data, intellectual property or other material that falls within the ambit of the policies:

E. INFORMATION ON THE YALE-NUS COLLEGE LEGACY PROJECT

Data Preservation
The Legacy Project team is committed to ensuring the long term preservation of materials relevant to the institutional history of the College, as well as sharing the archived materials in accordance with the policies of the College and NUS. To achieve this, the Legacy Project team will use its best endeavours to:

Content Review
While the Legacy Project preserves and provides access to materials deposited, the individuals submitting the material(s) either through online submission form or a Legacy Project-administrator-mediated submission, are solely responsible for the content of their submission.

Access Setting & Restrictions
The default access setting in the Legacy Project is “Public”, i.e. whenever possible, metadata records and materials deposited will be made accessible publicly via, but not limited to, the Legacy Website, College Digital Archives, physical exhibitions and non-commercial publications. Open access to deposited materials encourages their distribution, dissemination, promotion and use.

Where Contributor wish to request for access restrictions to be imposed on individual Contribution, please contact the Legacy Project administrators. These requests will be reviewed on a case-by-case basis by an administrator. Where such request for restrictions cannot be accommodated, Contributor should withdraw its Contribution.

Privacy Statement
The Legacy Project submission process or methods may collect personal information such as name, department, faculty, graduating class, contact number and email address submitted during the deposit process.

Submitted information will be used only for the purpose for which it is submitted, with the exception that the College Digital Archives may make reasonable statistical reports. The College Digital Archives does not share this information with any third-party organisations or allow it to be used for commercial purposes. Please refer to NUS’ Privacy Notice (and, for NUS staff and students, the Personal Data Protection Policy & Procedures) on how personal data collected will be managed and used.

LEGACY WEBSITE & COLLEGE DIGITAL ARCHIVES TERMS OF USE

A. ACCEPTANCE OF TERMS OF USE

The Yale-NUS College Digital Archives (“College Digital Archives”) consists of heritage digital materials curated and archived on this website (“Legacy Website”) for public access as part of Yale-NUS College Legacy Project (“Legacy Project”). The Legacy Project will include, in addition to the College Digital Archives and the Legacy Website, physical exhibitions, activities, publications, materials and memorabilia organised and archived to commemorate the history of Yale-NUS College.

The Legacy Project, Legacy Website and College Digital Archives are created, organised, owned and maintained by Yale-NUS College (“College”), an autonomous college established within the National University of Singapore (“NUS”).

All title and rights to the Legacy Project, Legacy Website and College Digital Archives are reserved to NUS.

Access to and/or use of the Legacy Website and the College Digital Archives is permitted to visitors to this website (collectively “Users” and individually a “User”) subject to the terms of use herein (“Terms of Use”).

By accessing or using the Legacy Website or College Digital Archives (collectively “Legacy Digital Resources”), you confirm that you accept the Terms of Use in full. If you do not agree with the Terms of Use or any part thereof, you should discontinue access to or use of the Legacy Digital Resources immediately.

B. USE OF THE LEGACY DIGITAL RESOURCES

  1. The Legacy Digital Resources may be used for academic, research, co-curricular, archival, historical record, or non-commercial commemorative purposes only. No other use is allowed without the prior written permission of the College or NUS.
  2. Users are prohibited from accessing or using the Legacy Digital Resources for or on behalf of another person or entity.
  3. Any use of the Legacy Digital Resources that breaches any applicable laws, or the College’s  or NUS’ rules and regulations, is strictly prohibited.
  4. NUS’ Privacy Notice (https://www.nus.edu.sg/ormc/personal-data-protection/nus-data-protection-policy) and its legal information and notices relating to its websites (https://nus.edu.sg/legal-information-notices) are incorporated and shall be deemed to form part of the Terms of Use. All references to “this Web-site”, “this website” or “NUS website” therein shall be deemed to include reference to the Legacy Digital Resources.
  5. The Legacy Digital Resources include and incorporate content belonging to the College and NUS. Apart from viewing and using such content for the purposes permitted under the Terms of Use, no part of the content may be reproduced, licensed, sold, published, transmitted, modified, adapted, publicly displayed, broadcasted, stored (including storage in any medium by electronic means, whether or not transiently) for any other purpose without the College’s or NUS’ prior written permission.
  6. The Legacy Digital Resources are provided “as is”. The College and NUS give no warranty and accept no responsibility or liability for the accuracy or the completeness of the Legacy Digital Resources for any purpose whatsoever. No reliance should be made by any User on the Legacy Digital Resources, and the User should independently verify the accuracy and completeness of any content accessed or used.
  7. All copyright in the content and materials in the Legacy Digital Resources belongs to the College and/or NUS unless otherwise indicated.
  8. The College’s and NUS’ logos, crests and names are trademarks or registered trademarks of the College and NUS. The College and NUS have policies governing the use of their names (including the names of their programmes) and trademarks; and use, reproduction, copying or redistribution of the same without the College’s and NUS’ prior written permission is prohibited. Other names or marks appearing in the Legacy Digital Resources that are not owned by the College or NUS are for identification purposes only and may be the registered or unregistered trademarks of their respective owners. No licence or right is granted to Users by implication, estoppel or otherwise to the use of any such third party names or marks.
  9. The College’s and NUS’ names and trademarks should never be removed from pages or content on which they originally appear and webpages from the Legacy Website and/or College Digital Archives should always appear exactly as posted without variation, unless the College’s or NUS’ prior written approval for such variation was obtained.
  10. Users may not use the Legacy Digital Resources in connection with any commercial endeavours, including but not limited to the sale and purchase of goods and services as a business, commercial advertisements, affiliate links, and other forms of solicitation. The decision by the College or NUS on what constitutes commercial use shall be final.
  11. Users shall not collect usernames and/or email addresses of other Users by electronic or other means.
  12. Users agree not to:

    1. use the Legacy Digital Resources to impersonate any person or entity;
    2. use the Legacy Digital Resources to transmit chain letters, junk emails or other form of spam to other Users;
    3. use information obtained from the Legacy Digital Resources for any objectionable purposes, including but not limited to harass, abuse or harm any individuals;
    4. interfere with or disrupt the Legacy Digital Resources, or the servers, networks or other infrastructure connected to the Legacy Digital Resources or disobey any requirements, procedures, policies or regulations of networks connected to the Legacy Digital Resources;
    5. use the Legacy Digital Resources to undermine the security of, tamper with or access the College’s or NUS’ IT resources, or attempt to do any of the same.
  13. The College and NUS reserves the right to require the removal of any links from external websites to the Legacy Digital Resources. Deep linking to any web pages of the Legacy Digital Resources is prohibited. Any links created by a User to the Legacy Digital Resources should be text links containing either the Legacy Website or the College Digital Archives domain name and which transfer visitors using the link directly to the Legacy Website homepage. The contents of the Legacy Digital Resources should not appear within the frames of other websites, nor be accompanied in any way by third-party material that may create a false or mistaken impression in the mind of the viewer about the College’s or NUS’ affiliation or association with or endorsement of the third party site, frame or material.
  14. The Legacy Digital Resources may contain links to third party websites. The College and NUS do not monitor and shall not be responsible for the content, material or opinions expressed on such third party websites or their accuracy thereof. Inclusion of any link to such third party websites in either the Legacy Website or the College Digital Archives does not imply approval or endorsement of the linked third party websites by the College or NUS, and Users access such linked third-party websites at their own risk.
  15. The Terms of Use shall be governed by and construed in accordance with the laws of Singapore, and any dispute shall be subject to the jurisdiction of the Singapore courts.

The User agrees to indemnify the College and/or NUS against any claims made against the College and/or NUS by any third party due to or arising out of the User’s use or access of the Legacy Digital Resources. The User further agrees that the College and NUS shall not be held responsible or be liable in any way for any consequences, damages or loss that may be incurred by the User as a direct or indirect result of using, or the inability to use, any content of the Legacy Digital Resources, even if the College or NUS has been advised of the possibility of such damages.

D. REPORT INAPPROPRIATE CONTENT

If you observe content on the Legacy Website or in the College Digital Archives that you believe is unlawful or in violation of the Terms of Use, please contact administrators of the Legacy Project by emailing legacy@yale-nus.edu.sg with the link to the relevant page(s) or the location of the content. Kindly include a short description of the violation.
